Position and place of work 3.1 乙方同意接受甲方聘请在___ __部门任 __ __职务。 Party B agrees to work as__ __ (job title) in __ _____ department. 3.2 甲方将安排乙方在杭州市 XXXXXXXXX 甲方:杭州 XXXX 酒店管理有限公司的杭 州 XXXX 酒店管理有限公司工作。 Party A will arrange Party B to work in the Hangzhou XXXX Hotel Management Co.,Ltd. located in XXXi Rd,XXXXX Street, Hangzhou 3.3 乙方应当认真履行职位工作职责, 按时保质保量的完成工作任务, 从而满足岗位职责、 公司管理政策、员工手册(含劳动纪律规范) 、培训标准、入店培训标准等甲方要求的各 项考核标准。 Party B shall diligently perform the responsibilities and duties of his/her position, and shall timely accomplish the tasks assigned to him/her with good quality, so as to meet the standards set out in the Job Description, Company Policy and Procedure, Associate Handbook which include Labor Discipline Policy , Training Standard, Company Orientation and Training Standard as required by Party A. 3.4 在合同期内,甲方可以根据工作需要或乙方工作能力及表现变动乙方的工作部门和职 位,变动需要征得乙方的同意并签订书面劳动合同变更书。一旦乙方同意甲方安排的工 作变动,乙方应执行甲方的工作安排,并按章履行变更手续。 Within the Contract Term, Party A may change Party B's position to meet Party A's business3need orto fit for Party B's capabilities or performance. Party A shall get Party B’s consent for such change, and an amendment contract to the Contract shall be concluded in writing. Party B shall comply with Party A's work arrangements, and shall go through the formalities for such change according to the rules concerned.四、工作时间和休息休假4. Working Time and Leave 4.1 甲方可安排乙方执行标准工时工作制或综合计算工时工作制. Party A may arrange Party B to work under the Standard Working Hour System or the Integrate Working Hour System according to the business requirements. 4.2 执行标准工时工作制时乙方每天实际工作时间为八小时(不含用餐时间) ,每周工作 四十小时,每周休息日及每天上下班时间由甲方视经营业务需要决定。 When implementing the Standard Working Hour System, Party B shall work eight (8) hours per working day, exclusive of lunch time, and forty (40) hours per week. The specific day-offs of each week and the working time for each working day shall be determined by Party A according to the requirements of the business and the specific position assigned to Party B. 4.3 执行综合计算工时工作制时, 乙方在计算周期内平均日工作时间为八小时, 平均周工 作时间为四十小时,每周休息日及每天上下班时间由甲方视经营业务需要决定。结算周 期:按 结算。 When implementing the Integrate Working Hour System, the average daily working time of Party B within a calculation period shall be eight (8) hours, and the average weekly working time shall be forty (40) hours, and the specific day-offs of each week and the working time for each working day shall be determined by Party A according to the requirements of the business and the specific position assigned to Party B. 4.4 乙方享受中华人民共和国所有法定的各种假期。 Party B is entitled to enjoy all legal holidays and other paid leaves in accordance with the laws and regulations concerned. 4.5 在遵守中华人民共和国现行有效的有关法律法规的前提下,乙方有权享受甲方企业规 定的各类假期。 Party B is entitled to enjoy the holidays and leaves prescribed by Party A, provided that such holidays and leaves comply with the competent laws and regulations of China.4五、劳动报酬5. Salary 5.1 乙方按甲方制定的工资等级制度及计发办法领取月薪金。乙方的月基本工资为人民币 _ _元。乙方工资的增减,奖金、津贴、补贴、加班工资的发放以及特殊情况下的工资 支付等,均按相关法律法规及甲方依法制定的规章制度执行。 Party B shall draw the salary in accordance with the internal salary ranking system and salary calculation and distribution regulations of Party A. The monthly salary (before deducting the income taxes) of Party B is RMB14000. . 5.2 甲方工资发放日每月 28 日,发放期为上月 21 日至本月 20 日。甲方不得无故拖欠 Salary is paid on 28th of each month covering 21st of the last month to 20th of this month. 5.3 甲方支付给乙方的月工资不得低于当地政府规定的最低工资。 The Salary must not be below the local minimum salary regulated by local government六、社会保险及其他保险福利待遇6. Social Insurance and Welfare 甲方依法为乙方缴纳基本养老保险、基本医疗保险、失业保险、工伤保险、生育保险和 基本住房公积金( “五险一金” )中应由甲方承担的部分。上述五险一金中涉及乙方个人 缴纳部分由乙方自行承担,由甲方从乙方的工资中代扣代缴。 Party A shall pay for Party B the employer’s portion of the basic endowment insurance, the basic medical insurance, the unemployment insurance, the industrial injury insurance, the maternity insurance and the basic housing funds (the “Five Insurance and One Fund”) in accordance with the competent laws and regulations. The employee’s portion of the said Five Insurance and One Fund shall be undertaken by Party B, which will be withheld by Party A from the salary of Party B.七 、 劳 动 保 护 和 劳动条件7. Labor Protection & Working Conditions 7.1 甲方根据保证生产安全的需要,按照国家有关劳动安全、卫生的规定为乙方配备必要 的安全防护措施。5To ensure the safety of production, Party A shall provide Party B with necessary protection method, in accordance with the provisions of the pertinent regulations/laws of the State in respect of Labor Safety and Health.7.2 乙方应当严格遵守甲方的劳动安全制度,严禁违章作业。 Party B shall strictly abide by the safety rules and the security guidelines of Party A, and is highly prohibited violating any rules or guidelines of Party A in respect of operation safety八、劳动合同的解除、终止和经济补偿8. Termination and Economic Compensation 8.1 乙方提前三十日以书面形式通知甲方,可以解除劳动合同。 Party B may terminate the Contract by30 days’ prior written notice to Party A. 8.2 在试用期期间,乙方需提前三日以书面形式通知甲方,可以解除劳动合同。 During the probation period, Party B may terminate the Contract by 3 days’ prior written notice to Party A. 8.3 属下列情形之一的,甲方可以单方解除本合同: Party A may terminate the Contract unilaterally under the following circumstances: 8.3 (1)、试用期内证明乙方不符合录用条件的; Party B is proved to be not satisfy the condition of recruitment during the probation period; 8.3 (2)、乙方严重违反劳动纪律或甲方规章制度的; Party B seriously violates the labor discipline, the rules or regulations of Party A; 8.3 (3)、严重失职、营私舞弊,对甲方利益造成重大损害的; Party B serious dereliction of duty or engagement in malpractice for selfish ends, due to which Party A incurred a great loss; 8.3 (4)、乙方同时与其他用人单位建立劳动关系,对完成甲方的工作任务造成严重影响, 或者经甲方提出,拒不改正的; Party B establishes employment relationship with other employers simultaneously, which6materially blocks Party A from accomplishing the working tasks assigned by Party B, or, Party A denies to correct the said behavior on receiving the warning of Party A on terminating the employment relationship with other employers; 8.3(5) 、乙方以欺诈、胁迫的手段或者乘人之危,使甲方在违背真实意思的情况下订立 或者变更劳动合同的; Party B uses illegal method, such as fraud or menace, to force Party A to conclude the Contract departing from its true intention; 8.3(6) 、乙方被依法追究刑事责任的; Party B is sued to undertake criminal liability in accordance with the criminal law; 8.3 (7)、法律法规规定的其他情形 Other circumstances prescribed by laws or regulations. 8.4 有下列情形之一的, 甲方提前三十日以书面形式通知乙方本人或者额外支付乙方一个 月工资后,可以解除劳动合同: Party A may terminate the Contract by giving Party B 30 days’ prior written notice, or paying one month’s salary to Party B, under the following circumstances: 8.4 (1)乙方患病或非因工负伤,医疗期满后不能从事本合同约定的工作,也不能从事由甲 方另行安排的工作的; Party B can neither take up his or her original position nor any kinds of new position reassigned by Party A after completion of medical treatment for illnesses or injuries not incurred for work reason; 8.4 (2)乙方不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的; Party B is incompetent for his or her position, and remains incompetent even after training or after readjusting the position; 8.4 (3)劳动合同定立时所依据的客观情况发生重大变化,致使劳动合同无法履行,经甲乙 双方协商,未能就变更劳动合同内容达成协议的; The objective circumstances relied on which the Contract was concluded materially changed, which causes the Contract can not be implemented any more, and after negotiation of both Parties, Party A and Party B are unable to reach agreement on amending the Contract. 8.5 终止、解除劳动合同时,乙方应按照甲方的安排妥善办理离职、工作交接手续,手续 办完后,方可结算最后工资。 When terminating the Contract, Party B shall hand over his/her works and go through the7departure formalities following the instructions of Party A, and then, Party A may settle the salary with Party B.九、不得终止或解除劳动合同9. Prohibitions on Terminating the Contract 符合下列情况之一者,甲方不得终止或者解除劳动合同: Under the following circumstances, Party A is prohibited to terminate this Contract: 9.1. 从事接触职业病危害作业的劳动者未进行离岗前职业健康检查,或者疑似职业病病 人在诊断或者医学观察期间的; Party B undertakes dangerous position which may bring about industrial disease but does not conduct demission health checkup, or Party B has been diagnosed as suspicious industrial disease carrier and is still in the observation period; 9.2. 在乙方患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的; Party B takes industrial disease or is injured for work reason and is confirmed of losing or partially losing of labor capabilities; 9.3 乙方患病或者非因公负伤在规定医疗期内的; Party B is ill or injured not for work reason and is still within the medical treatment period; 9.4. 乙方因工负伤或者患有职业病,在治疗期内的; Party B takes occupational disease or is injured for work reason and is still within the medical treatment period; 9.5. 乙方在孕期、产期和哺乳期内的; Party B is right in the pregnant period, in maternity period, or lactation period; 9.6. 法律、行政法规规定的其它情形。 Other circumstance specified by laws or regulations. 十、劳动纪律、奖励与处罚 10. Discipline, Rewards and Punishments 10.1 乙方应自觉遵守国家的各项法律、法规和甲方的各项规章制度。 Party B shall voluntarily comply with the laws and regulations of the State and the internal8rules and disciplines of Party A. 10.2 乙方若表现突出,甲方将给予物质或精神上的奖励。 Party A shall spiritually or materially reward Party B for his/her excellent performance. 10.3 乙方若违反甲方制定的《员工手册》及各项规章制度,甲方视其情节在符合有关法 律法规规定的前提下分别给予不同种类的处分直至解除劳动合同。 In the event that Party B breaches the provisions of the Associate Handbook or other rules/regulations of Party A, Party A may impose various punishments to Party B from warning to terminating the Contract. 十一、适用法律及争议解决 11. Applicable Laws and Disputes Resolution 11.1 本劳动合同的订立、变更、履行、效力、条款解释以及因本合同而发生的任何争议 均适用中华人民共和国的相关法律法规。 The establishment, amendments, implementation, effectiveness or interpretation of the terms of the Contract, as well as any disputes arising from the Contract, shall be governed by the relevant laws and regulations of PRC. 11.2 如甲乙双方发生劳动争议,应协商解决。协商无效,由争议一方或双方在争议发生 之日起六十日内向北京市劳动争议仲裁委员会申请仲裁。若不服仲裁裁决,可向甲方所 在地的人民法院提出诉讼。Both Parties shall try to settle the labor disputes through mutual consultation. If the Parties fail to come to an agreement, any or both Parties may submit the dispute to the Beijing Labor Dispute Arbitration Commission within sixty (60) days after the occurrence of the dispute. Any Party may bring the case to the People’s Court if such Party is not satisfied with the arbitration reward.11.2 下述文件为本合同附件,是本合同不可分割的组成部分。 Following documents are the appendix to this Labor Contract: (1)《员工手册》; Associate Handbook; (2)《岗位职责描述》 Job Description9十二、其它 12. Miscellaneous 12.1 本合同如需修改,须经双方协商同意,并签订书面《劳动合同变更书》 。 Any amendment to the Contract shall be subject to mutual consent and a amendment letter shall be concluded in written. 12.2 本合同以中英文本书写,若两种版本有不一致,以中文版本为准。 The Contract is made both in Chinese and English, and once the two versions have conflictions between each other, the Chinese version shall prevail. 12.3 本合同一式二份,甲、乙双方各执一份,具有同等法律效力。本合同由甲方授权代 表和乙方签字并经甲方盖章后生效。 The Contract is prepared in two counterparts,which contains the same legal effects, and each Party shall hold one.
