——农村宅基地使用权流转探析
摘 要
改革开放三十年后的今天,“三农”问题成了社会关注的焦点,而如何处理好农村土地问题,更成为解决“三农”问题的重中之重。其中,作为农民安身立命之本的宅基地,自农地承包经营权允许流转以后,也越来越成为解决“三农”问题的一个突破口。随着市场经济的发展和城镇化的推进,农村的大量人口流向城镇,由此造成了城市用地紧
张,农村宅基地闲置的尴尬局面。
我国限制农村宅基地使用权流转固然有其历史背景,也确实很大程度上保障了农民“居有其屋”,但在城乡二元经济结构问题严重及城乡差距不断扩大的今天,这一限制反而成了农民房地财产实现资本化收益的障碍。另外,保护耕地也不能成为限制宅基流转的理由,事实上,也没杜绝现实生活中大量宅基地使用权流转行为的私下进行,而且形成了一定规模的隐形市场。由此,放开宅基地流转势在必行。而放开宅基地的流转,不能一蹴而就,必须在体制上进行全面改革,并通过先实现宅基地使用权登记发证到法律修订再到全面放开的步骤逐步
进行。

Abstract
Reform and opening up three decades later, the problems facing agriculture, rural areas and farmers have become the focus of public attention. how to deal with the problem of rural land is the core problem to the "San Nong" problems. Especially, as the anchor of farmers’ life and spirit, the homestead land increasingly become a key solution to "San Nong"problems after allowing the contractual right of land to transfer. With the development of the market economy and the advancement of urbanization, the massive populations flow to the cities from countryside caused a embarrassing situation that the urban land is quite inadequate
and the rural house sites is idle.
The limitation of the rights to housing land use in our country has its historical perspective, and is also true to a large extent to protect the farmers "Home Ownership". With the urban-rural dual economic structure being serious problem and widening gap between urban and rural areas, however, the restrictions on the transfer of rights to rural housing land use has become a obstacle of capital gains. In addition, it’s not a reason for protecting arable land to limit the trasfer of rights to the
house land use. In matter of fact, it did not eliminate a large number of house sites circulation behavior advance in private, instead, a certain amount of stealth market has formed. Therefore, allow the rights to the
house land use to transfer is imperative.
And it’s can not be achieved overnight to open up the circulation. We must conduct a comprehensive institutional reform as far as achieve and
issue the card to the use registration of homestead right and then amending the law. Finally, open up the ban to transfer gradually based
on the steps.
